l,the undersigned participant, hereby recognize and consent that the term "The Event" comprehensively encompasses the entirety of the SWEATLAND MOBILE HEALTH AND RECOVERY LLC event and all related activities. This includes, but is not limited to, congregations of people, cold plunges, ice baths, saunas,serving and consuming food and beverages, compression therapy,stretching, physical activity, running, yoga, intravenous (lV) treatments, red light therapy, and various other activities associated with SWEATLAND MOBILE HEALTH AND RECOVERY LLC.

l, the undersigned participant, hereby acknowledge and agree that the term "Released Parties" refers collectively to SWEATLAND MOBILE HEALTH AND RECOVERY LLC and its owners,agents, and representatives.The term "Released Parties" also refers to all companies,employees, coffee providers, food providers, intravenous (lV) treatment providers, agents, contractors, subcontractors,participants of The Event, sponsoring agencies, sponsors, advertisers.owners and lessors of premises used to conduct The Event, and all other parties involved in the orchestration and execution of The Event.

I.ASSUMPTION OF THE RISKS

I recognize on behalf of self, spouse, heirs, estate, and assigns that the risk of injury from participation in The Event is significant.l recognize that severe injuries, including permanent paralysis or death, can occur as a result of my participation in The Event. Potential injuries include but are not limited to heart failure, loss of consciousness, and stroke and may be caused by extreme cold, ice baths, extreme heat, saunas,weather conditions, condition of participants, equipment, or other factors.

While particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury still does exist. l knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Released Parties or others such as participants of The Event, and l assume full responsibility for my participation, including any negligence on my part.

I acknowledge and understand that while participating in The Event:

I could be injured, physically or mentally, or in extremely rare cases may die.My personal property may be lost, damaged, or stolen at no responsibility of the Released Parties.

Other participants of The Event may cause me injury or may damage my property.

I may cause injury to other persons or damage their property.

The conditions in which the activity is conducted may vary without warning.

I may be injured, or die or suffer damage to my property as a result of negligence by the Released Parties.

There may be no or inadequate facilities for treatment or transport in case of an accident and/or injury.

There is a risk of slipping on wet surfaces or ice, which may result in injuries such as fractures, head trauma, or death.

There is a risk of risk electrocution from the use of electrical equipment during The Event, which may result in injury or death.

There is a risk of drowning, especially during activities involving water, which may result in injury or death.

There is a risk of hyperthermia from extreme heat exposure, which may result in heat-related illnesses such as heat exhaustion or heatstroke.

There is a risk of hypothermia from extreme cold exposure, which may result in cold-related illnesses such as frostbite or hypothermia.

There are risks associated with the consumption of food and beverages served at The Event which include but are not limited to: choking, food-borne illness, allergic reactions, or other adverse reactions. These risks may result from factors such as improper food handling, preparation, or storage, as well as individual dietary restrictions or sensitivities.

There is a risk of burns from hot surfaces, liquids, or equipment, which may result in injury ranging from minor burns to severe burns requiring medical attention.

I assume the risk of and responsibility for any injury, death, or property damage resulting from my participation in The Event. I understand that the list of potential risks provided is not exhaustive and that there may be other unforeseen hazards inherent in such activities. 

I hereby indemnify and hold harmless the Released Parties from any and all claims, causes of action, damages, judgments, costs, expenses, including but not limited to attorney fees and other litigation costs, which may arise from or are in any way connected with my participation in The Event.

II. PARTICIPATION AND MEDICAL RESPONSIBILITY

I, the undersigned participant, voluntarily engage in The Event, acknowledging my sole responsibility to ensure my physical and medical fitness for participation. I affirm I am not pregnant and have no known medical conditions preventing safe engagement. I understand that it is my responsibility to assess my own health and fitness for participation, including consulting with a healthcare professional if necessary. I also understand and acknowledge that I am required to disclose any known medical conditions or concerns that may impact my ability to safely participate in The Event.

Furthermore, I recognize that there may be unknown medical conditions or risks that could affect my ability to safely participate in The Event. "Unknown medical conditions" may include but are not limited to undiagnosed heart conditions, allergies, or underlying health issues that could pose a risk during participation. I commit to monitoring my health during the event and seeking immediate medical attention if I experience any symptoms of concern.

By signing below, I declare that I have fully considered the risks associated with participating in The Event, including those related to my own health and medical condition. I affirm that I am making an informed decision to participate despite these risks, acknowledging that participation is voluntary and that I assume full responsibility for any consequences.

By signing below, I also acknowledge that I am absolving the Released Parties from liabilities due to disclosed medical information, undisclosed medical information, or post-event conditions, whether known or unknown. I understand and agree that I assume full responsibility for any medical issues that may arise during or after the event, regardless of whether they were disclosed beforehand.

III. AGREEMENT TO FOLLOW DIRECTIONS

I agree to observe and obey all posted rules and warnings and further agree to follow any oral instructions or directions given by a representative of the Released Parties during The Event. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest representative of the Released Parties immediately.

I acknowledge and understand that while following the above instructions may reduce the risk of harm, it will not eliminate it entirely.

IV. RELEASE

I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release and hold harmless the Released Parties for any and all injury, disability, death, or loss or damage to person or property arising out of or in any way connected with my participation in The Event, including but not limited to injuries resulting from negligence, recklessness, whether such negligence is attributable to myself or the Released Parties, to the fullest extent permitted by law.

I expressly acknowledge and agree that participation in The Event involves inherent risks, as outlined in Section I of this Agreement. I knowingly and voluntarily assume all risks associated with participation in The Event, including those arising from extreme cold, heat, physical exertion, equipment failure, or the actions or inactions of the Release Parties or participants of The Event, regardless of whether such risks are known or unknown to me at the time of signing this Agreement.

This Release of Liability constitutes the entire agreement between the parties and supersedes any prior agreements or understandings, whether written or oral, relating to the subject matter herein. This Agreement may only be modified or amended in writing and signed by both parties. The terms of this Release of Liability shall be binding upon the parties, their successors, assigns, heirs, and legal representatives.

This release encompasses all claims, demands, liabilities, damages, actions, or causes of action, whether known or unknown, anticipated or unanticipated, suspected or unsuspected, including but not limited to those arising from bodily injury, emotional distress, property damage, or death, and all legal fees and costs associated therewith, regardless of whether such claims or liabilities arise in tort, contract, or any other legal theory, to the fullest extent permitted by law.

I have carefully read this release of liability and assumption of risk agreement, fully understand its terms, and acknowledge that I am freely and voluntarily signing it without any inducement, coercion, or misrepresentation. I further affirm that I am of legal age and competent to enter into this Agreement, and I understand that my signature on this document is a binding legal agreement.

V. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, causes of action, damages, judgments, costs, expenses, including but not limited to attorney fees and other litigation costs, which may arise from or are in any way connected with my participation in The Event. This indemnification extends to all claims, demands, liabilities, damages, actions, or causes of action, including those brought by third parties, arising from my actions, omissions, negligence, or willful misconduct during The Event.

I further agree that this indemnification obligation shall survive the termination or expiration of this Agreement and shall continue in full force and effect thereafter.

By signing below, I acknowledge that I have read, understand, and agree to the terms of this indemnification provision. I agree that my obligation to indemnify the Released Parties is a material part of this Agreement and that my failure to fulfill this obligation may result in legal action against me.

VI. NO DURESS

I, the undersigned participant, affirm that I am signing this Agreement voluntarily and of my own free will, without any coercion, duress, or undue influence from any party. I confirm that I have had sufficient time to review the terms of this Agreement and to seek legal counsel or clarification regarding its terms.

I confirm that I have read, understood, and agree to the terms of this Agreement. I affirm that I am of legal age and possess the legal capacity to enter into this Agreement. I affirm that I have entered into this Agreement freely and voluntarily, without any inducement or pressure from any party.

VII. ARM'S LENGTH AGREEMENT

This Agreement and each of its terms are the product of a fair and transparent negotiation process between the Parties. Both parties had equal opportunity to review, negotiate, and seek legal advice regarding the terms of the agreement. Any power imbalances that may have existed were acknowledged and addressed to ensure the fairness of the negotiation process.

In the event of any ambiguity in the interpretation of this Agreement or any of its provisions, the Parties agree to work together in good faith to clarify such ambiguities and reach a mutual understanding. Both parties affirm that the agreement should be interpreted in a manner that reflects their true intentions, regardless of drafting responsibilities.

The Parties explicitly reject the application of any legal or equitable rule of interpretation that would lead to a construction either "for" or "against" a particular party based solely on their status as the drafter of specific terms, language, or provisions giving rise to such ambiguity.

Both parties affirm that they entered into this Agreement voluntarily, without coercion, duress, or undue influence from any party.

VIII. SEVERABILITY

The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other application of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.

In the event that any provision of this Agreement is found to be invalid or unenforceable under applicable law, the Parties agree that disputes arising from the severability or modification of provisions shall be resolved through arbitration as outlined in Section X. The Parties shall engage in arbitration proceedings administered by a neutral arbitration organization, in accordance with its rules and procedures. The decision of the arbitrator(s) shall be final and binding upon the Parties, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

IX. PHOTOGRAPH LICENSE

I understand that while participating in The Event, I may be filmed or photographed. I hereby grant to the Released Parties and their affiliates a perpetual, indefinite, worldwide, royalty-free license to use my photograph, video, or film likeness for any legitimate purpose, including but not limited to:

Promotional materials related to the current event and future events organized by the Released Parties.

Use on websites, social media platforms, and other digital channels owned or operated by the Released Parties.

Distribution to third-party partners or sponsors for promotional purposes related to The Event or similar events.

Commercial use, including but not limited to endorsements, sponsorships, and advertising campaigns. Such commercial use may involve direct financial gain for the Released Parties, and I waive any rights to compensation for such use.  

I acknowledge that the use of my likeness may occur without any compensation to me. Additionally, I waive any right to inspect or approve the finished product or its use. I understand that the Released Parties will not be responsible for any misuse of my likeness by third parties.

By signing this Agreement, I confirm that I have read, understood, and agree to the terms of this photograph license, and I voluntarily grant the described rights to the Released Parties.

X. GOVERNING LAW

Any dispute, claim, or controversy arising out of or relating to this Agreement, including its interpretation, validity, breach, or termination, shall be resolved through arbitration administered by the American Arbitration Association ("AAA"). The arbitrator(s) shall be selected by mutual agreement between myself (hereinafter referred to as the "Participant") and the Release Parties, or, failing such agreement, shall be appointed by the AAA in accordance with its rules.

I recognize that if I am unable to participate in the arbitration proceedings, whether due to incapacity, death, or any other reason, then all individuals mentioned in this Agreement, including myself, my spouse, heirs, estate, assigns, and any other related parties (collectively referred to as the "Related Parties"), shall be bound by the arbitration process. The decision of the arbitrator(s) shall be final and binding upon myself and all Related Parties, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

I, as well as all additional Related Parties, waive our right to a trial by jury and to any form of class action in connection with any dispute, claim, or controversy arising out of or relating to this Agreement. Each of us shall bear our own costs and expenses incurred in connection with the arbitration proceedings, including but not limited to attorneys' fees and expert witness fees, unless otherwise awarded by the arbitrator(s) in accordance with applicable law.

This arbitration provision shall survive the termination or expiration of this Agreement and shall be enforceable notwithstanding any subsequent modification or amendment to this Agreement.

XI. Confirmation and Acknowledgment

I, the undersigned participant, hereby affirm that I have read this release of liability and assumption of risk agreement in its entirety. I understand and acknowledge that by signing this agreement, I am voluntarily consenting to its terms and conditions.

I confirm that I fully comprehend the risks involved in participating in the event, as outlined in this agreement, including but not limited to those related to physical injuries and death. Additionally, I understand that by signing this agreement, I am releasing the Released Parties from any liability arising from my participation in The Event.

I affirm that my signature on this agreement is given freely and voluntarily, without any coercion, duress, or inducement from any party. I acknowledge that I have had sufficient time to review and consider the terms of this agreement and that I understand the consequences of signing it.

By signing this agreement, I acknowledge that I have given up substantial rights, including the right to pursue legal action against the Released Parties, and I do so of my own volition.
