PARTICIPANT WAIVER, RELEASE OF LIABILITY & PHOTO CONSENT
Fitness Event — Yoga, Pilates & Bootcamp
 
This Waiver and Release of Liability ("Agreement") is entered into voluntarily by the participant ("Participant") in connection with participation in any and all fitness activities, classes, workshops, and events organized or facilitated by Unfiltered Growth with Sydney ("Organizer"), including but not limited to yoga, Pilates, and bootcamp-style fitness classes, held at Westport Plaza or any other designated venue.
 
Please read this Agreement carefully and in its entirety before agreeing. By clicking "I Agree," you acknowledge that you have read, understood, and agree to be bound by all terms and conditions herein.

1. ASSUMPTION OF RISK
 
The Participant acknowledges and understands that participation in physical fitness activities, including yoga, Pilates, and bootcamp-style training, involves inherent risks of physical injury, illness, or death. These risks include but are not limited to: muscle strains, sprains, fractures, dislocations, overexertion, cardiovascular incidents, and other physical or psychological injuries.
 
The Participant voluntarily and knowingly assumes full responsibility for all risks associated with participation, whether foreseeable or unforeseeable, and whether arising from the negligence of the Organizer, instructors, staff, volunteers, vendors, or venue.

2. RELEASE OF LIABILITY
 
In consideration for being permitted to participate in events organized by Unfiltered Growth with Sydney, the Participant, on behalf of themselves, their heirs, personal representatives, successors, and assigns, hereby RELEASES, WAIVES, DISCHARGES, and COVENANTS NOT TO SUE the following parties (collectively, "Released Parties"):
 
(a) Unfiltered Growth with Sydney and its owner, Sydney, employees, contractors, agents, volunteers, and representatives;
(b) All participating vendors, sponsors, exhibitors, and their respective employees, contractors, and representatives;
(c) Westport Plaza, its owners, managers, employees, agents, and affiliates;
(d) Any co-organizers, partners, or affiliated entities involved in the production or delivery of the event.
 
This release applies to ALL claims, demands, actions, causes of action, liabilities, damages, costs, and expenses of any kind whatsoever, whether known or unknown, arising out of or in connection with the Participant's attendance at or participation in any event, including claims resulting from the NEGLIGENCE of any Released Party.

3. MEDICAL FITNESS & HEALTH REPRESENTATION
 
The Participant represents and warrants that they are in good physical health and have no medical condition, injury, or disability that would prevent safe participation in the activities. The Participant agrees to inform the instructor of any relevant health conditions, injuries, or limitations prior to participating.
 
The Participant acknowledges that Unfiltered Growth with Sydney is not a medical provider and that its instructors are not medical professionals. Nothing communicated during any class or event constitutes medical advice.

4. PHOTO & VIDEO CONSENT
 
The Participant grants Unfiltered Growth with Sydney, its vendors, and affiliated parties the irrevocable right and permission to photograph, film, record, and use the Participant's image, likeness, voice, and appearance captured during any event for any lawful purpose, including but not limited to:
 
(a) Social media marketing and promotional content (Instagram, Facebook, TikTok, etc.);
(b) Website content, blog posts, and email marketing;
(c) Print materials, press releases, and advertising;
(d) Future event promotion and brand content.
 
The Participant waives any right to inspect, approve, or receive compensation for such use. This consent applies to all photographs and recordings taken at any Unfiltered Growth with Sydney event.

5. INDEMNIFICATION
 
The Participant agrees to INDEMNIFY, DEFEND, and HOLD HARMLESS all Released Parties from and against any and all claims, lawsuits, demands, judgments, costs, expenses, and attorney fees arising from or related to: (a) the Participant's participation in any event; (b) the Participant's breach of this Agreement; or (c) the Participant's negligent or wrongful conduct.

6. EMERGENCY MEDICAL AUTHORIZATION
 
In the event that the Participant is unable to make medical decisions for themselves, the Participant authorizes Unfiltered Growth with Sydney staff to consent to emergency medical treatment on their behalf. The Participant accepts full financial responsibility for any medical treatment received.

7. RULES & CONDUCT
 
The Participant agrees to follow all instructions provided by instructors and event staff, to respect all safety guidelines, and to conduct themselves in a manner that does not endanger themselves or others. Unfiltered Growth with Sydney reserves the right to remove any Participant from an event for unsafe or disruptive behavior without refund.

8. INSURANCE ACKNOWLEDGMENT
 
The Participant understands that Unfiltered Growth with Sydney carries liability insurance; however, this insurance may not cover all losses or injuries. The Participant is encouraged to maintain their own personal health and accident insurance coverage.

9. SEVERABILITY & GOVERNING LAW
 
If any provision of this Agreement is found to be unenforceable, the remaining provisions shall continue in full force and effect. This Agreement shall be governed by and construed in accordance with the laws of the State of Missouri. Any disputes arising under this Agreement shall be resolved exclusively in the courts of St. Louis County, Missouri.

10. ENTIRE AGREEMENT
 
This Agreement constitutes the entire understanding between the Participant and Unfiltered Growth with Sydney with respect to its subject matter and supersedes all prior agreements, understandings, and representations.

BY CLICKING "I AGREE," I ACKNOWLEDGE THAT I HAVE READ THIS ENTIRE AGREEMENT, THAT I UNDERSTAND ITS TERMS, AND THAT I AGREE TO BE LEGALLY BOUND BY IT. I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE. I AGREE TO THIS AGREEMENT FREELY AND VOLUNTARILY.
