I, the undersigned participant (“Participant”), in consideration of being allowed to take part in **The Worst Party Ever** fitness/yoga program on Fort Lauderdale Beach, Florida (the “Program”), acknowledge and agree as follows:

### 1. Participation Risks

I understand the Program involves strenuous physical activity that may result in slips, choking, burns, hypothermia, drowning, allergic reactions, serious injury, or death. I have consulted a physician or knowingly proceed with full awareness of these risks, which I voluntarily assume.

### 2. Photography, Video & Intellectual Property

I may be photographed, filmed, or recorded during the Program. All such content (“Content”) is the sole property of **The Worst Party Ever**, the **City of Fort Lauderdale**, vAr Communications, the contracted Fort Lauderdale Beach Open Spaces Coordinator, their agents, sponsors, affiliates, volunteers, contractors, officers, and employees (collectively, the “Releases”). The Releases have the irrevocable right, without inspection, approval, or additional compensation, to use and publish the Content in any medium—including social media, websites, and advertising—provided it is not used for pornographic or illegal purposes. I waive any claims for invasion of privacy, copyright infringement, defamation, or other personal or property rights arising from such use.

### 3. Communications Consent

By providing my contact information, I consent to receive calls, texts (including auto‑dialed or pre‑recorded), and emails from the Releases. Message and data rates may apply.

### 4. Assumption of Responsibility

I accept full responsibility for any bodily injury, death, or property damage arising out of my participation in the Program.

### 5. Indemnification

I agree to indemnify, defend, and hold harmless the Releases from any loss, liability, or cost—including attorney’s fees—resulting from my participation or related activities.

### 6. Release & Covenant Not to Sue

I voluntarily assume all risks and forever release, discharge, and covenant not to sue the Releases for any bodily injury, property damage, or death arising from my participation, whether due to negligence or otherwise.

### 7. Governing Law & Venue

This Agreement is governed by Florida law. Any dispute shall be brought exclusively in the state or federal courts located in Broward County, Florida. I waive any objection to personal jurisdiction or venue.

### 8. Attorney’s Fees & Costs

In any dispute arising under this Agreement, the prevailing party is entitled to reasonable attorney’s fees and costs at all levels, including appeals.

### 9. Jury Trial Waiver

Each party waives the right to a trial by jury in any action related to or arising out of this Agreement.
