**BARC x SweatPals Honolulu Marathon Retreat Liability Waiver & Release**

**Participant Waiver, Release of Liability, Assumption of Risk, and Indemnity Agreement**

**Event:** BARC x SweatPals Honolulu Marathon Retreat + Club Paddle
**Dates:** December 2025
**Location:** Honolulu, Hawaii (various public spaces, beaches, roads, and vendor locations)

By registering for or attending this event, I (“Participant”) acknowledge and agree to the following:

## **1. Assumption of Risk**

I understand that participating in the Honolulu Marathon, shakeout runs, ocean activities, paddle boarding, group workouts, social gatherings, and all related programming involves inherent risks, including but not limited to:

* Physical injury, illness, dehydration, exhaustion
* Accidents caused by uneven surfaces, weather, vehicles, or other participants
* Ocean risks such as currents, waves, wildlife, and water-related injury
* Equipment failure or improper use of paddleboards or other gear
* Slip, fall, or impact injuries
* Heat-related illness
* Exposure to contagious diseases

I voluntarily assume all such risks, known and unknown, and accept full responsibility for my participation.

## **2. Release of Liability**

I hereby release, waive, and discharge the following parties from any and all claims, liabilities, demands, actions, or causes of action arising from or related to my participation in this event:

* SweatPals, Inc.
* BARC (Body Art Run Club)
* Club Paddle
* All organizers, team members, volunteers, and affiliates
* Event partners, sponsors, and vendors
* Any independent instructors or contractors
* Any venues, beaches, parks, or public spaces used
* The City & County of Honolulu
* State of Hawaii agencies involved in permitting or public use

This release applies to claims arising from negligence of the released parties, to the fullest extent permitted by law.

## **3. Medical Fitness**

I certify that I am physically capable of participating in all selected activities and have no medical conditions that would prevent safe involvement. I agree to stop participation immediately if I feel unwell, unsafe, or unable to continue.

In the event of injury or emergency, I authorize event staff, volunteers, or medical personnel to secure any necessary medical treatment at my expense.

## **4. Personal Responsibility**

I understand and agree that:

* I am responsible for my own hydration, nutrition, pacing, and rest.
* I am responsible for my belongings at all times.
* Alcohol consumption (if present) is at my own discretion and risk.
* Participation in ocean or paddle activities is voluntary and requires good judgment.

## **5. Indemnification**

I agree to defend, indemnify, and hold harmless the released parties from any claims, damages, expenses, or liabilities arising out of my participation, including claims brought by third parties.

## **6. Media Release**

I grant permission for SweatPals, BARC, Club Paddle, and event partners to use photos, videos, and recordings of me from this event for marketing, social media, and promotional purposes. I understand no compensation will be provided.

## **7. Acknowledgment of Terms**

I have read this agreement carefully and understand its contents. I am aware that by signing, I am giving up legal rights and assuming all risks associated with participation.

By submitting this form, I acknowledge that this constitutes my electronic signature and agreement to all terms stated above.
