**BODY ART RUN CLUB WAIVER & RELEASE OF LIABILITY**

**PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A RELEASE OF LIABILITY AND WAIVER OF CERTAIN LEGAL RIGHTS.**

By signing this agreement, I acknowledge and agree to the following:

### 1. **Voluntary Participation**

I am voluntarily participating in the \[Run Club Name] Beach Party, including but not limited to physical activities such as running, walking, swimming, beach games, and social activities including food and beverage consumption (collectively, the “Event”).

### 2. **Assumption of Risk**

I understand that participation in this Event involves inherent risks, including but not limited to:

* Physical exertion and injury (e.g. sprains, dehydration, or cardiac events)
* Exposure to sun, heat, uneven terrain, and ocean water
* Slips, trips, or falls on sand, boardwalks, or wet surfaces
* Interaction with other participants and the general public
* Consumption of food and beverages that may cause allergic reactions or other health issues

I knowingly and freely assume all such risks, whether known or unknown, even if arising from the negligence of the event organizers.

### 3. **Release of Liability**

I hereby waive, release, and discharge \[Run Club Name], its organizers, volunteers, sponsors, partners, and affiliated parties (collectively, the “Released Parties”) from any and all liability for any injury, illness, damages, loss, or death that may result from my participation in the Event.

### 4. **Indemnification**

I agree to indemnify and hold harmless the Released Parties from any claims brought against them due to my actions during the Event, including but not limited to property damage, injuries to others, or violations of law.

### 5. **Health & Fitness to Participate**

I represent that I am in good physical condition and capable of safely participating in the Event. I will not participate if I am ill, injured, or otherwise unfit to do so. I acknowledge that no medical services may be provided on site.

### 6. **Photography & Media Release**

I grant permission to the Released Parties to use photographs, video, or audio recordings taken of me during the Event for promotional or marketing purposes, without compensation.

### 7. **Alcohol & Substances**

If alcohol is consumed, I agree to do so responsibly and understand that I am solely responsible for my actions and safety. I will not operate a vehicle under the influence and will comply with all local laws and event rules.

### 8. **Severability**

If any provision of this waiver is found to be unenforceable, the remaining terms shall remain in full force and effect.

### 9. **Jurisdiction**

This waiver shall be governed by the laws of the State of California. Any legal disputes will be handled in courts located in San Diego County, California.
