WMP EYEWEAR EVENT PARTICIPATION AGREEMENT, LIABILITY WAIVER & MEDIA RELEASE

PLEASE READ CAREFULLY — THIS AGREEMENT INCLUDES A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS.

By registering for or attending this pickleball event (the “Event”), I agree to the following:

1. Assumption of Risk

I understand that participation in athletic and promotional events involves inherent and significant risks. Activities at the Event may include, without limitation:

Pickleball play and athletic competition

Use of courts, equipment, and facilities

Vendor-provided services, including massage therapy and cold plunge exposure

Product demonstrations and promotional activities

Spectating and general attendance

I acknowledge that risks include, but are not limited to:

Slips, trips, and falls

Collisions with players or equipment

Sprains, fractures, muscle strain, dehydration

Illness, cardiac events, or cold exposure complications

Equipment malfunction

Negligent acts of other participants

Vendor malpractice or improper service

Property damage or theft

I voluntarily and knowingly assume all risks, known and unknown, even if arising from the negligence of the Released Parties (defined below), except in cases of gross negligence or willful misconduct.

2. Release of Liability

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless WMP Eyewear, Scottsdale Pickleball Club, event sponsors, vendors, partners, affiliates, officers, directors, employees, agents, successors, and assigns (collectively, the “Released Parties”) from any and all claims, liabilities, damages, losses, demands, or causes of action arising out of or related to:

My participation in or attendance at the Event

Use of facilities or equipment

Vendor-provided services (including massage and cold plunge)

Acts or omissions of other participants

Negligence of the Released Parties

This release includes claims for personal injury, illness, death, property damage, emotional distress, and economic loss.

3. Vendor & Third-Party Services Disclaimer

I acknowledge that certain services at the Event may be provided by independent third-party vendors.

I understand and agree that:

Vendors are independent contractors and not employees or agents of WMP Eyewear.

WMP Eyewear does not supervise or control vendor medical, therapeutic, or wellness services.

I assume all risk associated with participation in vendor-provided services.

WMP Eyewear shall not be liable for any malpractice, injury, adverse reaction, or outcome arising from services provided by third-party vendors.

4. Medical Representation

I represent and warrant that:

I am physically fit and able to participate.

I have consulted a physician if I have any medical concerns.

I will not participate under the influence of drugs or alcohol.

I am solely responsible for monitoring my physical condition during the Event.

I understand that the Released Parties do not provide medical supervision.

5. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, damages, losses, costs, liabilities, or expenses (including attorneys’ fees) arising from:

My participation in the Event

My conduct at the Event

My violation of Event rules

Any claim brought by or on behalf of a minor I register

6. Conduct, Safety & Right of Removal

I agree to comply with all Event rules, safety instructions, and staff directives.

WMP Eyewear and the Scottsdale Pickleball Club reserve the right, in their sole discretion, to deny entry to, remove, or suspend any participant or attendee for:

Unsafe behavior

Intoxication

Harassment or misconduct

Disruptive or harmful conduct

Violation of Event rules

Removal may occur without refund or compensation.

7. No Responsibility for Personal Property

I understand that I am solely responsible for my personal property.

The Released Parties are not responsible for lost, stolen, or damaged belongings.

8. Limitation of Liability

To the fullest extent permitted by law, the total liability of the Released Parties for any and all claims arising out of or relating to the Event shall not exceed the amount paid by me, if any, for participation in the Event.

Under no circumstances shall the Released Parties be liable for:

Indirect damages

Consequential damages

Incidental damages

Special damages

Punitive damages

Lost profits

Reputational harm

This limitation applies regardless of legal theory, whether in contract, tort, negligence, strict liability, or otherwise.

9. Media Release & Commercial Use Consent

I voluntarily consent to being photographed, filmed, and recorded at the Event.

I hereby grant WMP Eyewear and its affiliates, successors, licensees, agents, and assigns an irrevocable, perpetual, worldwide, royalty-free right and license to use, reproduce, edit, modify, create derivative works from, publish, distribute, display, perform, and otherwise exploit my name, image, voice, likeness, and any photographs, video, or audio recordings containing me (the “Content”), in any and all media now known or later developed, for any lawful purpose, including but not limited to:

Advertising

Paid media campaigns

Social media advertising and retargeting

Promotional materials

Marketing campaigns

Commercial and brand purposes

I understand and agree that:

The Content may be edited, altered, cropped, combined, or modified.

I have no right to inspect or approve final materials.

This consent is perpetual and may not be revoked.

I waive any claims relating to rights of publicity, privacy, defamation, or compensation.

Use of my image does not create endorsement rights, employment, or compensation obligations.

10. Governing Law & Severability

This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona.

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

11. Acknowledgment

I certify that:

I am at least 18 years of age, OR

I am the parent or legal guardian of a minor participant and have authority to sign on their behalf.

I have carefully read this Agreement, understand its contents, and agree that it is intended to be as broad and inclusive as permitted by law.

By registering for or attending the Event, I acknowledge that I am giving up substantial legal rights.
