INTERNATIONAL YOGA DAY MIAMI
WAIVER OF LIABILITY, ASSUMPTION OF RISK, RELEASE, INDEMNIFICATION, CLASS ACTION WAIVER, AND JURY TRIAL WAIVER AGREEMENT

PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO SUE, YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION, AND YOUR RIGHT TO A JURY TRIAL.

In consideration of being permitted to attend or participate in International Yoga Day Miami and all related activities (the “Event”), I agree as follows:

DEFINITIONS
“Event” includes, without limitation: yoga classes, fitness activities, meditation, wellness workshops, demonstrations, vendor interactions, food and beverage consumption, product samples, educational programming, performances, children’s activities, and presence at event grounds.
“Released Parties” include:
Namaskar Foundation Corporation
Namaste Life LLC
International Yoga Day Miami
Miami-Dade County Fair & Exposition, Inc.
Miami-Dade County
The City of Miami
The Town of Miami (if applicable)
Any applicable governmental or municipal authority
Event sponsors, vendors, exhibitors, food vendors, instructors, volunteers, staff, contractors, security personnel, partners, and venue operators
Officers, directors, employees, agents, representatives, successors, and assigns of all of the above

VOLUNTARY PARTICIPATION
I acknowledge participation is voluntary and I choose to attend or participate of my own free will.

ASSUMPTION OF RISK
I understand the Event involves inherent risks which cannot be completely eliminated.
Risks may include, but are not limited to:
Muscle strain, sprains, fractures, or joint injuries
Slips, trips, or falls
Concussions or loss of consciousness
Heat exhaustion, dehydration, or heat stroke
Hypothermia
Allergic reactions to food, products, or environmental exposure
Foodborne illness or choking hazards
Exposure to bacteria, viruses, or communicable illness
Aggravation of pre-existing medical conditions
Injury from crowds or environmental conditions
Unknown or unforeseen risks
I knowingly and freely assume all risks, known or unknown.

HEALTH & MEDICAL RESPONSIBILITY
I certify I am physically able to participate and accept full responsibility for my participation decisions.

RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by Florida law, I release, waive, and discharge the Released Parties from any and all claims, including claims arising from negligence, related to participation in or attendance at the Event.

COVENANT NOT TO SUE
I agree that neither I, nor anyone acting on my behalf (including heirs, estate representatives, or successors), will file or pursue legal action against any Released Party for claims covered by this Agreement.

INDEMNIFICATION AND HOLD HARMLESS
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, losses, liabilities, or expenses (including attorneys’ fees and court costs) arising from:
My participation in the Event
My violation of this Agreement
Injury or damage I cause to others or property

VENDOR PRODUCTS, FOOD, SAMPLES & THIRD-PARTY SERVICES
Sponsors and vendors operate independently.
Any products, food, beverage, or samples (free or purchased) are accepted voluntarily and at my own risk.
Released Parties make no guarantees regarding vendor goods or services.

EMERGENCY MEDICAL CARE
I authorize emergency medical treatment if needed and accept financial responsibility.

NOT MEDICAL ADVICE
Event content is educational only and is not medical advice. Please consult your physician. 

MEDIA RELEASE
I grant permission for my likeness or voice to be used for promotional or commercial purposes without compensation.

PERSONAL PROPERTY
I am responsible for my belongings. Released Parties are not responsible for loss or theft.

CODE OF CONDUCT
Organizers may remove participants for unsafe or disruptive behavior.

MINORS
If signing for a minor, I certify I am parent or legal guardian and:
Agree to this waiver on behalf of the minor
Assume risks on behalf of the minor
Agree to indemnify Released Parties for claims involving the minor

CLASS ACTION WAIVER
To the fullest extent permitted by law, I agree that any claim or dispute arising from or related to the Event must be brought solely in my individual capacity and not as part of any class action, collective action, mass action, or representative proceeding.
I agree not to participate as a class member, class representative, or in any consolidated or representative legal proceeding against any Released Party.

WAIVER OF JURY TRIAL
To the fullest extent permitted by law, I knowingly and voluntarily waive any right to a jury trial in any legal proceeding arising from or related to the Event or this Agreement.
Any such dispute shall be resolved by a judge sitting without a jury.

BINDING EFFECT
This Agreement is binding on me and my heirs, estate, executors, administrators, successors, and assigns.

GOVERNING LAW
This Agreement is governed by Florida law. Venue shall be Miami-Dade County, Florida.

SEVERABILITY
If any portion is held invalid, the remaining provisions remain enforceable.

ELECTRONIC SIGNATURE CONSENT
Electronic acceptance has the same legal effect as a handwritten signature.

ACKNOWLEDGMENT OF UNDERSTANDING
I acknowledge I have read, understood, and voluntarily agree to this Agreement.
